Who is responsible for sidewalk repair?
It depends on where the sidewalk is and which city it's in.
- City of Melbourne: city code says broken or cracked sidewalks are a nuisance and makes the owner of the property they're on, or next to, responsible for fixing them. If repairs aren't made within 30 days of notice, the city can do the work and place a lien on the property. Repairs follow city specifications. (LDC Sec. 9.120)
- Melbourne specs: new city sidewalks must be concrete at least 4 inches thick, and 6 inches where they cross a driveway. (LDC Sec. 9.107)
- Palm Bay: building, repairing or replacing a sidewalk in a city road or easement needs a Public Works permit. (Code § 176.020)
- Unincorporated Brevard County: sidewalk work in a county road or easement needs a right-of-way/easement permit from Public Works. (Code Sec. 86-101)
- Other cities, or a private walkway at a church, HOA or business: check with your city's building department, or ask us during your estimate.
